Update on SPCA of Texas Seizures

It looks like Mr. Earnest Kearney, 76, is going to try to stand up to the SPCA of Texas and he's got supporters who say things aren't as the SPCA's selective photos indicate.  "The store is a landmark in rural Dallas County. It has been open for more than 100 years, first as Frank Ellis and Son, and later as Lander Mercantile. It burned down in 1994 but was rebuilt by the Kearneys in late 1995.  Earnest Kearney, 76, started working there when he was just 8 years old."

The "officials" declined to show the Kearny family the specifics of what they allege are violations and "SPCA didn't allow media access".  Yes, of course, we're all just supposed to take SPCA's word for it.

The SPCA of Texas reports seizing 386 animals.  "105 chickens, 79 pigeons, 41 rabbits, 35 horses (34 miniature horses and one paint), 33 goats, 27 doves, 22 sheep, 16 turkeys, nine ducks, six cattle, four potbellied pigs, four guineas, two geese, 2 mules and one donkey"  "animals' conditions range from good to extremely poor" Id.  Did they take the ones in "good" condition.  I'll bet they did!  Gonna run that vet and care bill up as fast as they can.

It appears the Kearneys have purchased livestock from others for years when they were in poor condition, brought them up to health, and resold them.  But, of course, we're all supposed to know that ONLY the SPCA and similar groups are qualified to do that.  Oh, my, whatever did we do with these animals before they came around?  Oh, yes, I remember.  We depended on local businesses doing the job.  Too bad they actually need to make a profit instead of getting PR an donations from the public based on their slanted perspective (to put it politely).

"The custody hearing will be held on Thursday, October 15, 2009 at 9:30 a.m. at the Dallas County Justice of the Peace Precinct 2 Courthouse, Justice of the Peace Cooper presiding."

First, these are livestock.  Using the term "custody" is inappropriate especially when you're talking about permanent deprivation of property.  This is a possession and ownership hearing, nothing less, nothing more.

Second, Best wishes to Mr. Kearney, his family and supporters.  Make them prove it up (if they can)!
